MAOIST CENTRAL COMMITTEE CONTNUES FOR SECOND DAY
Kathmandu, 15 Nov.: Maoist central committee meets for the second consecutive day Tuesday.
The meeting will discuss Tuesday First Vice-chairman Mohan Baidya’s 13-point differing opinion criticizing Chairman Prachanda for his leadership of the party and its management.
The Maoist chief presented his own political report for adoption.
The central committee has been empowered to discuss escalating differences in the party leading the government beginning with the handover by the establishment of keys to containers with insurgency-era weapons to special government committee headed by Prime Minister Baburam Bhattarai.
The committee meetings had been repeatedly delayed.
Baidya added three more criticisms to his original 10-point paper, including Prachanda’s most recent USA visit.

NC OFFFICE BEARERS MEET
Kathmandu, 15 Nov.: Office bearers of main opposition NC meets Tuesday amid simmering differences in the party.
Senior leader and three time Prime Minister Sher Bahadur Deuba has resigned from the central committee criticizing President Sushil Koirala of dictatorial tendencies by dissolving executive bodies of several fraternal organizations with close Deuba links.
Deuba says the president doesn’t has dissolution powers of elected bodies.
Koirala hasn’t accepted the resignation.
The office bearers also meet as the 30 November deadline to complete the peace process and promulgate a constitution approaches.
The party has to decide whether to extend or not the deadline of parliament/constituent assembly again to meet the twin tasks after 30 November.

16 SENIOR OFFICIALS TRANSFERRED IN HOME MINISTRY
Kathmandu, 15 Nov.: Ministry of Home Affairs today [Monday] transferred joint secretaries and a number of Chief District Officers (CDOs), The Home Ministry reports.

Home Minister and Deputy Prime Minister Bijaya Kumar Gachhadar decided to transfer 16 joint secretaries. Joint secretary Shankar Prasad Koirala has got the place of Sudhir Kumar Shah, chief of peace and security division and Shah has been deputed as Director General of Department of Immigration (DoI).

Koirala, who was previously in the department of planning and special service of MoHA has also been assigned as spokesperson. A few days after Gachhadar assumed office, he had transferred home secretary Lilamani Paudel. His transfer had broken the PM’s word that no official would be transferred for a couple of months.

FORMER POLICE CHIEFS SUMMONED BY SPECIAL COURT 23, 27 DECEMBER
Kathmandu, 15 Nov.: Special court Tuesday summoned former IGPs Achyut Krishna Kharel and Motilal Bohara to appear before it on different days 23 and 27 December.
CIAA has registered corruption charges against the two former chiefs.
The supreme court overturned a special court judgment dismissing the charges on technicality.

TRUTH AND RECONCILIATION COMMISSION BILL BEING FNALIZED WEDNESDAY
Kathmandu, 15 Nov.: Three major political parties — the Unified CPN-Maoist, Nepali Congress and CPN-UML — today [Monday] agreed to finalise bills on Truth and Reconciliation Commission and Commission of Inquiry on Disappearances on Wednesday.

A three-party meeting held at the Office of the Prime Minister in Singha Durbar today decided to finalise all the contentious issues related to the two bills through consensus on Wednesday, according to NC General Secretary Krishna Prasad Sitaula.

Granting general amnesty to those involved in killing someone in captivity, killing of an unarmed person, rape, forced disappearances and abduction of a person for ransom is one of the contentious issues of the TRC bill. There are some other issues as well which are interlinked between TRC and CID and need to be addressed. Other issues, however, have already been finalised by a parliamentary statutory committee.

Leaders also reached an understanding today to intensify process to implement the November 1 seven-point deal and begin preliminary tasks of categorising Maoist combatants from tomorrow by endorsing a detailed work plan of the Special Committee (for supervision, integration and rehabilitation of Maoist combatants), said NC Vice President Ramchandra Paudel.

LEGAL OPTIONS FOR PRESIDENT DISCUSSED IN AMNESTY CASE FOR MAOIST LAWMAKER CONVICTED FOR MURDER
Kathmandu, 15 Nov.: Prominent lawyers and legal experts have claimed that President Dr. Ram Baran Yadav could send back the Cabinet recommendation for presidential pardon to UCPN-Maoist lawmaker Balkrishna Dhungel by not implementing it, The Himalayan Times reports..

Speaking at an interaction programme in Kathmandu, Bhimarjun Acharya, a constitutional expert, said that the President can seek opinion on the issue from the Supreme Court and lawyers, put the recommendation on hold for a long time or send it back to the Cabinet for reconsideration by expressing dissatisfaction over it.

He also argued that the case is not a political one as claimed by the Maoist since the victim, Ujjan Kumar Shrestha, was not involved in the politics.

Chairman of Nepal Bar Association Prem Bahadur Khadka urged President Dr Yadav not to implement the Cabinet recommendation on lawmaker Dhungel.

Arguing that the President could reject the Cabinet decision if the decision is against the national interest, he also urged the Cabinet to reconsider it.

He also warned of stern protest against the government move if the recommendation was implemented. He made it clear that the country will not progress if such tendency goes ahead.

Also speaking in the programme, lawyer Harihar Dahal claimed that Shrestha’s murder was carried out in connection with his love affair and inter caste marriage and added that lawmaker Dhungel hasn’t claimed his act to be a political one in the court statement.

Claiming that there is no constitutional provision to grant pardon to a convict, he said that even the conflict era cases cannot be withdrawn on individual basis.

However, addressing the same programme, former registrar of the Supreme Court, Shree Prasad Pandit argued that a person convicted by court can also get presidential pardon.
