NBA COMES DOWN ON CHIEF JUSTICE REGMI FOR ACTING CODE OF CONDUCT FOR JUDGES
Kathmandu, 26 Feb.:- Nepal Bar Association (NBA), the umbrella body of Nepali lawyaers, has termed the proposed appointment of the Chief Justice to the post of the Prime Minister as being against judicial norms and values, RSS reports..
The appointment of the head of the judiciary who has to make a judicial review of the unconstitutional acts of the state organs as the executive head would be against the fundamental principle of independence of judiciary, the principle of separation of powers and other international agreements that Nepal is party to, the Bar has said.
A meeting of the NBA office-bearers held on Tuesday also decided to demand for a full meeting of the Supreme Court to make its views public with regards to the statement issued by the Court on behalf of the Chief Justice on Monday.
"It is against the judges' code of conduct for the Chief Justice to attend a meeting of political parties, issue a statement on an issue that is under consideration at the court and give statements in support of it in the media", reads a statement issued by the Bar following the meeting.
It would now be against the code of conduct for the Chief Justice to continue his duties of execution of justice and the act has put him into a moral crisis, adds the statement issued by the Bar General Secretary Sunil Kumar Pokharel.
