ADHIKARI MURDER PROBE HITS HURDLE
Kathmandu, 17Aug.:: A vague reply by government prosecutor’s office, Chitwan, to a police query has put the police in a dilemma whether or not to proceed with the investigation into the murder of Krishna Prasad Adhikari, who was killed following his abduction by the Maoists during insurgency some nine years ago, Surya Prasad Jandel reports in the Himalayan Times from Narayangarh..
Chitwan police chief Superintendent of Police Pradumna Karki had written to the office of the prosecutor seeking its advice in clear legal terms whether to proceed with the probe or not. But the office’s reply to go ahead with investigation as per National Human Rights Commission’s directive has only added to the confusion. On top of that the police are ignorant about the ‘NHRC directive’.
After NHRC wrote a letter to the interim election government Chairman Khil Raj Regmi to initiate investigation into Adhikari murder, the government had directed the police headquarters to start the probe. Chitwan police then wrote to the government prosecutor’s office. Karki said his office had re-written to the prosecutor’s office to give clear and unequivocal advice on the investigation procedure. “We are waiting for an unequivocal legal order to proceed with the investigation,” Karki said.
On the other hand, government attorney Ek Narayan Lamsal said NHRC directive’s implementation was obligatory. He said his office had suggested to proceed with the investigation as per the commission’s directive.
After the Nepal government decided not to proceed with cases related to conflict-era on 12 June 2006, Chitwan police had closed investigation into Adhikari murder.
Sit-in and fast-unto-death by the deceased’s parents from Gorkha, Nanda Prasad and Ganga Maya, led NHRC to pressure the government to re-investigate the case.
Adhikari, 18, was murdered a day after his abduction on 6 June 2004 by the cadres of the then CPN (M) when he had gone to Chitwan to meet relatives.
The deceased’s brother Nur Prasad had filed an FIR at the District Police Office, Chitwan, against Januka Paudel, Chhabilal Paudel, Bhimsen Paudel, Parsuram Paudel, Bishnu Tiwari, Kali Prasad Tiwari and Sita Adhikari on 7 June 2004.
On 5 April 2009, NHRC recommended the government to investigate into the incident, give compensation to the victim’s family and provide environment for the displaced family to return home. But it was its directive last week that swung police into action.

BPKIHS had published the results of the entrance examination of MBBS and BDS on August 6. It published the results again on August 8 and 13, for the second and the third time, respectively.
The candidates, who had passed the exam when the results were out on August 6, found their names missing when the results were republished for the second and the third time. Smelling a rat, they had filed a case at the CIAA.
After a case of irregularity was registered with the CIAA against the Examination Committee chaired by BPKIHS Rector Bikram Prasad Shrestha, the anti-graft body had directed the Sunsari DAO to investigate. As many as 2,278 candidates had sat for the entrance examination held on August 3 for 120 MBBS and BDS quota seats. The students have alleged that BPKIHS’ decision to publish the results thrice was due to the anomalies within.
Sunsari CDO Laxman Thapa said they had raided and seized all the documents related to the examination. Under Thapa’s leadership, DIG Upendra Kant Aryal, SSP Yadav Raj Khanal and SSP Ganesh Bahadur Thapa had raided the institute. According to CDO Thapa, as per CIAA’s directive, they have seized all the answer sheets, results, attendance sheets, and CPUs. “We will seal all the documents and send them to the CIAA tomorrow,” CDO Thapa said.
Meanwhile, Rector Shrestha admitted of errors in the results that were published on August 6. “We had to republish the results as the results published for the first time were flawed,” Shrestha said. He, however, refuted the irregularity charge.
Vice-chancellor of BPKIHS, BP Das, said all the documents related to the examination had been seized as per the CIAA’s order. Das dismissed his involvement as the entire responsibility for exam conduction was given to Rector Shrestha. He further said classes will remain suspended until the CIAA asks them to resume classes again.
