SC GIVES BREATHING SPACE FOR ONE MORE EXTENSION OF CA; ANY EXTENSION THEREAFTER WILL BE ILLEGAL

Kathmandu, 25 Nov.: In a delayed verdict, a five-Member bench of the supreme court headed by apex court Chief Justice Khilraj Regmi Friday gave legal sanctity to a last extension of the constituent assembly (CA)’parliament after 30 November.
Another extension will be illegal, according to the apex court, thereafter llegal if a basic law isn’t promulgated after the last extension.
Dissolution and fresh assembly election is the only option for government and parties following another failure, the court noted in its judgment.
SC didn’t specify the duration for the extension.
The CA has failed to draft and promulgate a constitution to institutionalize a declared republic by an unelected parliament; an elected CA was given a two-year tenure to finalize a basic law.
Even five years after the 12-point New Delhi accord between Maoists mostly living in self-exile in India and not in Nepal’s jungles, a constitution hasn’t been promulgated even with repeated extensions for six or three months.
After each extension, parties waste time politicking to cling to power or conspire to pull down governments; the dormant parties suddenly become active when the deadline to promulgate a basic law again approaches.
The court announced a decision on a writ of
advocate Bharat Mani Jangam challenging the last extension of the CA.
Ruling parties and opposition NC and UML couldn’t decide on the duration of the CA extension at a meeting and deferred their decision until Sunday seeking time for consultations.
NC office bearers have been empowered by the central committee to decide the duration of a fresh assembly extension.
The central committee met amid a boycott by the Deuba faction.
UML also couldn’t decide on the duration of the
extension and another meeting will decide the issue.
